Tax Evasion Prosecutions, HMRC Investigations

Forths • October 16, 2014

As HMRC continues to plough its efforts into reducing the UK tax deficit, recent figures show that the number of court prosecutions for tax evasion have risen by a third.

The information was gathered by Thompson Reuters, with the report showing a 29% increase on the previous years figures.

Tax Evasion Prosecutions

The number of prosecutions for tax evasion were at:

  • 795 in 2013/14
  • 617 in 2012/13
The increase has been driven by HMRC’s focus on targeting those it suspects of tax evasion, and this trend looks set to continue as a target of over 1150 prosecutions has been laid down for next year.

Recently it announced plans to bring more cases to criminal courts as a way of ensuring that those who have deliberately avoided paying tax on income or gains from offshore assets and bank accounts are subject to appropriate penalties and convictions.

HMRC Investigations

In most cases HMRC investigations start out as civil investigations. However, those who have deliberately failed to declare information as part of the process will be subject to criminal prosecution.

For those with assets and bank accounts held offshore, it may be the case that you have fallen onto HMRC’s radar. In order to mitigate against facing a full tax investigation, potential prosecution and increased penalties you should seek the advantage of HMRC’s disclosure facilities. We can assist in making voluntary disclosures to HMRC.

With HMRC raising its targets once more and introducing new strategies such as Accelerated Payment Notices (APNs), waiting is no longer an option for many.

If you do not pay your tax there are a number of actions HMRC may take in order to recover unpaid tax debt. Depending on the circumstances this could take the form of either a tax investigation or HMRC debt enforcement action.
